Marital Agreements

Have You Thought of a Prenup?

Marriage forms a binding contract between you and your spouse. In essence, either you determine your rights and obligations, or the state legislature dictates them. With the right legal support, and with the assistance of Searcy Friedman Law, you have the power to decide how best to protect your assets and income through a prenuptial agreement, commonly called a prenup.

Our legal knowledge and drafting ability will assure the validity and enforceability of your prenup. Even if you opt against one, we encourage those tying the knot to at least know what potential rights and obligations they are signing up for—or signing away.

For instance, if you are entering into your second marriage, you can unintentionally disinherit your children from your first marriage by the sheer fact that you have chosen to remarry. Read that again.

30 Years from Now

Prenups have garnered a reputation for being a cold and “unsexy” way to begin a marriage. You might wonder: Why would I need a prenup if I never plan on getting divorced? Here’s the answer: the person you divorce is often not the same person you married. Prenups are not for everyone. That said, your decision whether to enter into one should be an informed one. Prenups often make us ask very personal and difficult questions of ourselves and our partners. Searcy Friedman can advise you on whether one is right for you. And if you are going to have one—or have been asked to enter into one—we want you to make an informed decision. After all, the prenup you sign today might be the prenup you have 30 years from now.

What Are Postnups?

Even after marriage, you and your spouse still have the ability to enter an agreement defining marital and separate property, and determining how property will be treated in the event of death or divorce.
In Colorado, the law accepts and enforces marital agreements executed during marriages, or postnups, provided they were not made in contemplation of divorce. At Searcy Friedman Law, we assess your particular circumstances to advise you and draft an enforceable postnup, ultimately giving you peace of mind.

A Well-Drafted Marital Agreement

It’s important that the marital agreement you enter into with your soon-to-be spouse meets your state’s specific requirements. While it’s true that prenups are generally not expensive, the cost of cutting corners to save a thousand dollars could cost you hundreds of thousands—if not millions. At Searcy Friedman Law, we understand the importance of making sure your prenup has all the requirements to hold up in a court of law. Equally important, you need to understand how the prenup you sign today could affect you 10, 20, or 30 years down the road.

For example, maybe you build a business that becomes a substantial asset. Or maybe you step back from working outside the home to enable one party to become the breadwinner. While we don’t have a magic crystal ball, you need someone who can explain all the permutations of scenarios and their corollary repercussions. Because, at the end of the day, sometimes in life, you just don’t know what you don’t really know.
